مصطلح التردد في مختصر الشيخ خليل من خلال مواهب الجليل

Abstract

ملخص البحث: بسم الله الرحمن الرحيم الحمد لله والصلاة والسلام على رسول الله. أما بعد: يتناول هذا البحث موضوع الخلاف النازل في هذا المذهب. يركز البحث على علمين بارزين في المذهب المالكي وهما الشيخ خليل رحمه الله والإمام الحطاب رحمه الله يتمثل دور هؤلاء العلماء في البحث من خلال دراسة مصطلح معين اقتبسه الشيخ خليل في مختصره المشهور، وهو مصطلح "التردد". حيث يشير هذا المصطلح إلى تردد المتأخرين في نقل العلم عن المتقدمين أو ترددهم في الفهم نظرًا لعدم وجود نص قاطع من المتقدمين. تم استقصاء هذا المصطلح من خلال شرح الإمام الحطاب لمختصر الشيخ خليل المعروف باسم "مواهب الجليل في شرح مختصر خليل". وقد تم التركيز في البحث على نماذج مأخوذة من كتاب الحج تم تنظيم البحث على النحو التالي: مقدمة، وفصلان، الأول للتعريف بالعلماء والكتب المعنية، والثاني لدراسة مصطلح التردد وعلاقته بالخلاف النازل، مع توضيح المواضع التي ذكر فيها الشيخ خليل مصطلح التردد في كتاب الحج. وختام البحث يتضمن أهم النتائج وبعض الاقتراحات. هذا هو ملخص بحثنا، وختامه الصلاة والسلام على خير الأنام، سيدنا محمد ﷺ الكلمات المفتاحية : تردد ، مختصر، خليل ، شرح ، الحطاب ،الحج .

Research Summary: In the name of Allah, the Most Gracious, the Most Merciful. All praise is due to Allah, and peace and blessings be upon the Messenger of Allah. To proceed: This research addresses the topic of scholarly disagreement within the Maliki school of thought. It focuses on two prominent scholars in the Maliki school, namely Sheikh Khalil (may Allah have mercy on him) and Imam Al-Hattab (may Allah have mercy on him). The role of these scholars in the research is illustrated through the study of a specific term cited by Sheikh Khalil in his famous abridgment, which is the term "Tarddud" (hesitation). This term refers to the hesitation of later scholars in transmitting knowledge from earlier ones or their hesitation in understanding due to the absence of conclusive texts from the early scholars. This term is examined through Imam Al-Hattab's explanation of Sheikh Khalil's abridgment, known as "Muwahib al-Jalil fi Sharh Mukhtasar Khalil." The research focuses on examples taken from the book of Hajj. The research is organized as follows: an introduction, two chapters, the first to introduce the scholars and relevant books, and the second to study the term "Tarddud" and its relation to scholarly disagreement, elucidating the passages where Sheikh Khalil mentioned the term "Tarddud" in the book of Hajj. The conclusion of the research includes the most important findings and some suggestions.
