التيسير وأثره في الاختلاف الفقهي

Abstract

لخص الدراسة إن التيسير في هذا الدين روح تسري في جسم الشريعة كلها، كما تسري العصارة في أغصان الشجرة الحية، وهذا التيسير مبني على رعاية ضعف الإنسان، وكثرة أعبائه وتعدد مشاغله، وضغط الحياة ومتطلباتها، وشارع هذا الدين رؤوف رحيم، لا يريد بعباده عنتا ولا رهقا، إنما يريد لهم الخير والسعادة، فالتيسير رحمة من الله بعباده فلم يكلفهم بما لا يطيقونولكنه امتثال لأمر الله. إذا فالتيسير هو باب الحرص على أداء الفرائض والإعفاء مما في بذله مشقة وجهد غير عادي. ومع كل الوضوح الذي حملته تشريعات هذا الدين بشأن التيسير، فإن فريقا لم يستوعبوا هذا الأمر، فأخذوا على أنفسهم بالشدة فقها وعملا، وجاء فريقا آخر وخالفهم في الأمر فسلك مسلكا أخر يدعوا إلى التخفيف، فتعددت بذلك الآراء الفقهية وكثرة الاختلافات بين علماء الأمة. وتهدف دراستنا إلى توضيح الخلاف القائم بين الأئمة حول التيسير في الأحكام الشرعية بعدم التشدد في الوقوف على النصوص في فرعيات الدين، وتوضيح في فروعيات الدين، وتوضيح فكرة أن الفقهاء لما اختلفوا حول النص القرآن - والسنة ذاته، إنما كان اختلافهم حول وسائل فهمه وطرائقه، وما يحيط به. ومنه فقد كان عنوان الدراسة موسوما ب - "الاختلاف الفقهي وأثره في التيسير". الكلمات المفتاحية: التيسير، الاختلاف، الاختلاف الفقهي. With all the clarity that the legislation of this religion carried regarding facilitation, a group did not understand this matter, so they took it upon themselves to be harsh in jurisprudence and practice, and another team came and contradicted them in the matter, so it took another path calling for mitigation, so there were many jurisprudential opinions and the large number of differences between the scholars of the nation. Our study aims to clarify the existing dispute between the imams about facilitating legal rulings by not being strict in standing on the texts in the branches of religion, and clarifying the branches of religion, and clarifying the idea that the jurists did not differ about the text - the Qur’an and the Sunnah - itself, but their difference was about the means of understanding it and its methods, and what surrounds it.
