Abstract

ملخص: تناولنا في هذا العمل دراسة لبعض نماذج كتاب التفريع لابن الجلّاب، حيث كشفنا عن بعض جوانب المنهج الفقهي لابن الجلّاب بعد عرض مشكلة الدراسة ومبرراتها والدراسات السابقة، وقد عرفنا في عملنا هذا بالإمام ابن الجلّاب رحمه الله وكتابه التفريع ثم تناولنا حياته شيوخه وتلاميذه وآثاره العلمية. تناولنا أيضا المذهب المالكي تعريفه وكيفية تأسيسه وأصوله وعلاقة ابن الجلاب بالمذهب المالكي من خلال المدرسة العراقية كونه ينتمي الى العراق، ثم بعد ذلك في عنصر مهم تعرفنا على منهج ابن الجلاب من خلال مقدمة التفريع لحسين الدهماني. كذلك تطرقنا في الفصل الثاني لبعض نماذج مختارة من فقه العبادات أنموذج من كتاب الطهارة ممثلا في إزالة النجاسة، وأنموذج من كتاب الصلاة في باب العمل في قضاء ما نسي من الصلوات، وأنموذج في كتاب الزكاة في زكاة الدين، وأنموذج في كتاب الصيام في باب صيام التطوع، وقمنا بشرحها حتى يظهر لنا منهج ابن الجلّاب جليا في نقاط مهمة: الوضوح والإحاطة بما وصل إليه الفقه في عصره مع تحقيق تلك الآراء وترجيح ما حقه الترجيح وتطبيقها على المسائل الفقهية، واستنباط الأحكام وتقعيد القواعد للمسائل التي لم يرد فيها حكم ، فتجد منهجه يقوم على أربعة أركان هي: التفريع والتفصيل، والايجاز والاختصار وتقرير الأحكام، والتبسيط والتوضيح. summary: In this work, we studied some examples of Ibn Al-Jallab’s book Al-Tafri’, where we revealed some aspects of Ibn Al-Jallab’s jurisprudential approach after presenting the problem of the study, its justifications, and previous studies. In this work, we introduced us to Imam Ibn Al-Jallab, may God have mercy on him, and his book Al-Tafari’, then we discussed his life, his sheikhs and students, and his scientific effects. We also discussed the Maliki school of thought, its definition, how it was founded, its origins, and Ibn al-Jallab’s relationship with the Maliki school of thought through the Iraqi school, as he belongs to Iraq. Then, in an important element, we learned about Ibn al-Jallab’s approach through the introduction to the branching by Hussein al-Dahmani. We also discussed in the second chapter some selected examples of the jurisprudence of worship, a model from the Book of Purity, represented by the removal of impurity, a model from the Book of Prayer, in the chapter on work, in making up for forgotten prayers, a model in the Book of Zakat, in the zakat on debt, and a model in the Book on Fasting, in the chapter on voluntary fasting. We have explained it so that Ibn al-Jallab’s approach appears clearly to us in important points: clarity and understanding of what jurisprudence had reached in his time, while verifying those opinions and giving weight to what is due weight, and applying them to jurisprudential issues, and deriving rulings and restricting rules to issues in which no ruling was mentioned. You will find his approach is based on Four pillars are: branching and detailing, brevity and abbreviation, stating rulings, and simplification and clarification.
