Abstract

الملخـــص تهدف هذه الدراسة لاستخراج القواعد الفقهية من كتاب الكافي في فقه أهل المدينة باب النكاح نموذجا. - والتي بنى عليها أحكامه وفتاويه وذلك انطلاقا من الإشكالية الآتية: ماهي القواعد الفقهية المستخرجة من كتاب النكاح ؟ ومن بين هذه القواعد : " المنكوحات على أصل الحل إلا ماحرمه الدليل " وقاعدة "كل لفظ أوعرف يدل على مقصود النكاح فينعقد به" . ومن النتائج المتوصل إليها أن لكل قاعدة فقهية مدلول ومستند شرعي من الكتاب والسنة، وأنها حجة يستدل بها في استنباط الأحكام ، وأن منها ماهو متعدٍ وماهو قاصر على محلّه ، كما أنها متعلقة بأفعال المكلفين وتصرفاتهم وأقوال الشرع مما صدر عنهم من التزامات، وأن معرفة الدليل دليل للقاعدة، وأن الأصل في القواعد الفقهية أنها تصاغ صياغة خيرية تقريرية لأنها تدل على حكم، فإذاكان هناك خلاف متساوي الأطراف فتصاغ عندئذ صياغة استفهامية .
