علم فقه النّوازل هوعلم يعنى باستنباط الأحكام الشّرعية للوقائع المستجدة الّتي لم

يرد فيها نصّ صريح في الكتاب أوالسنّـة، أمّاعلـــم المقاصد فيساعده على كشف

العلل والحكـــم وتطبيقها على الوقائع، ومعالجتها بشكـــل يحقّق مصالــــح العباد

العباد وفق مراد الله تعــالى دون مغالاة ولا تمييـــع،" فلا إفراط ولا تفريــــــــط"،

ومنه فإن المتمكّن من علم مقاصد الشّريعــة الإسلاميّــــة هو الأقدر على استنباط
