مصطلح التردد عند الشيخ خليل دراسة في كتاب الشرح الكبير كتاب الزكاة انموذجا

Abstract

ملخص البحث: الحمد لله والصلاة والسلام على رسول الله أما بعد: إن هذا البحث الموسوم بمصطلح التردد عند الإمام خليل في كتاب الزكاة من خلال كتابه المختصر والذي اعتمدنا فيه على الشرح الكبير للشيخ الدردير جاء ليتناول عدة نقاط كانت على الشكل التالي: إن موضوع البحث يتعلق بعالمين كبيرين من أعلام الإسلام عموما وداخل المذهب المالكي خصوصا درسنا فيه مصطلح التردد والذي قصد به الشيخ خليل تردد المتأخرين في النقل عن المتقدمين أو ترددها لعدم نص المتقدمين موضوع البحث يندرج تحت الفقه المقارن داخل المذهب المالكي أو ما اصطلح عليه بالخلاف النازل وبعدها انتهجنا خطة هذا رسمها: مقدمة ذكرنا فيها أهمية وأهداف هذه الدراسة وطرحنا فيها إشكالية البحث والخطة المتبعة فيه ثم قسمنا هذا البحث الى فصلين: الفصل الأول: ترجمة الشيخ خليل والتعريف بكتابه المختصر والمبحث الثاني في ترجمة العلامة الإمام الدردير والتعريف بكتابه الشرح الكبير على مختصر سيدي خليل والفصل الثاني: خصصناه لشرح مصطلحات البحث فكان عنوانه، العناصر المفاهيمية والمبحث الثاني ذكرنا فيه مواضع التردد التي ذكرت في باب الزكاة حيث جعلناها على شكل مسائل فنذكر المسألة كما وردت عند الشيخ خليل ثم نفردها بشرح الإمام الدردير وتعليقاته عليها، ونحرر فيها محل الخلاف ونذكر أقوال العلماء ثم القول الراجح والمعتمد في المذهب. ثم جعلنا خاتمه ذكرنا فيها أهم النتائج المستخلصة مع بعض التوصيات. هذا ملخص بحثنا فالحمد لله ألا واخرا وخير ما نختم به الصلاة والسلام على رسول الله .

Research Summary: Praise be to God, and prayers and peace be upon the Messenger of God, as for what follows: This research, which is characterized by the term hesitation according to Imam Khalil in the book of zakat through his brief book, in which we relied on the great explanation by Sheikh Dardir, came to address several points that were as follows: The subject of the research concerns two great scholars of Islam in general and within the Maliki school of thought in particular In it, we studied the term hesitation, by which Sheikh Khalil meant the hesitation of the latecomers in quoting from the earlier ones, or its hesitation due to the lack of text of the earlier ones The subject of the research falls under comparative jurisprudence within the Maliki school of thought, or what is termed the emerging dispute Then we adopted this plan: An introduction in which we mentioned the importance and objectives of this study and presented the problem of the research and the plan followed in it. Then we divided this research into two chapters: The first chapter: The translation of Sheikh Khalil and the introduction to his book Al-Mukhtasar, and the second section is about the translation of the scholar Imam Al-Dardir and the introduction to his book Al-Sharh Al-Kabir on Al-Mukhtasar by Sidi Khalil. Chapter Two: We devoted it to explaining the research terms, so its title was, Conceptual Elements The second section is in which we mentioned the places of hesitation that were mentioned in the chapter on zakat, where we put them in the form of issues, so we mention the issue as it was mentioned by Sheikh Khalil, then we separate it with Imam Dardir’s explanation and his comments on it, and we edit out the area of disagreement and mention the sayings of the scholars, then the most correct and approved opinion in the doctrine. Then we made a conclusion in which we mentioned the most important results drawn with some recommendations. This is a summary of our research. Praise be to God. Finally, and the best thing to conclude with is prayers and peace be upon the Messenger of God.
