فقه الفاروق من خلال الموطا

Abstract

الحمد لله وكفى والصلاة وسلاماً على رسول الله وعلى آله وصحبه ومن وعلاه، أما بعد: فهذا بحث بعنوان فقه الفاروق رضي الله عنه من خلال الموطأ كتاب النكاح أنموذجا مقارناً بآراء الفقراء جمعت فيه الآثار المروية عن سيدنا عمر في النكاح ورتبتها ترتيبا يتلاءم مع مسائل أبواب النكاح، وحكمت على ما جاء فيها بين الموقوف والبلاغات، واستنبطت فقه الفاروق منها، وقارنته بفقه غيره من المجتهدين، مع التركيز على المذاهب الأربعة المعتمدة، وأوردت أدلة الموافقين والمخالفين لعمر رضي الله عنه، ورجحت ما عضده الدليل من الأقوال، وقد ثبت من خلال البحث أن الفاروق رضي الله عنه صاحب فقه واسع وغزير حيث شملت آراؤه الفقهية معظم مسائل كتاب النكاح، كما أثبت البحث أن الفاروق رضي الله عنه صاحب بصيرة نافذة ورأي حاذق ويكفيه شهادة على ذلك موافقاته الكثيرة للقرآن الكريم وشهادة السنة له بالفضل والعلم مما أدى بتأثر الإمام مالك رضى الله عنه تأثرا يعبر عنه كثيرة مروياته في كتاب الموطأ مقارنة بغيره من الخلفاء الذين لم ير لهم مثل أبوبكر الصديق رضي الله عنه و قليلة مثل روايتان لعلي وثلاث روايات لعثمان رضي الله عنهم أجمعين، وآخر دعوانا أن الحمد لله رب العالمين.
