قاعدة المعاممة بنقيض القصد وتطبيقاتها عند المالكية

Abstract

الملخص: لقد وقفنا في ىذا البحث عمى قاعدة فرعية ميمة وىي قاعدة المعاممة بنقيض القصد، التي تضبط تصرفات المكمّفين في مختمف الأبواب الفقيية التي وقفنا عمييا من خلال الد ا رسة التأصيمية والتطبيقية. وتوصّمت د ا رستنا من خلال ىذه القاعدة إلى أنّ قصد المكمّف بتصرفاتو كمّيا لابدّ أن يكون قصده موافقا لمشرع، وداخلا تحت سمطان الإمتثال. الكممات المفتاحية : القواعد الفقيية، نقيض القصد، المالكية، التطبيق : Abstract In this research, we have studied an important sub-rule, which is the rule of treatment with the opposite intent, which controls the actions of the worshiper in the various jurisprudential chapters, that we have come across through the fundamental and applied study. Our study concluded through this rule that the intention of the worshipers in all his actions must be in accordance with the Sharia, and within the compliance authority.
