القواعد الفقهية و المقاصدية الضابطة للعمل الخيري و التطوعي

Abstract

الملخص: اشتمل موضوع بحثنا هذا المعنون ب: القواعد الفقهية والمقاصدية الناظمة للعمل الخيري والتطوعي، على مقدمة احتوت في طياتها على بيان أهمية وأهداف هذا الموضوع، المتمثلة في إبراز أهم القواعد الفقهية والمقاصدية الناظمة للعمل الخيري والتطوعي، وأسباب اختيار هذا الموضوع، هو رغبتنا في البحث العلمي عامة، وفي هذا الموضوع خاصة، وكذلك بعض الدراسات السابقة المتناولة في موضوعاتها ما يشبه موضوع بحثنا، وبيان المناهج والمنهجية المتبعة، وبعض الصعوبات التي واجهتنا، والإشكال الرئيسي الذي كان فيه: ما هي أهم القواعد الفقهية والمقاصدية الناظمة للعمل الخيري والتطوعي؟. وللإجابة عليه سرنا على ما يلي: الفصل الأول تناولنا فيه أهم التعريفات للقواعد الفقهية والمقاصدية والعمل الخيري والتطوعي مع ذكر الأدلة من الكتاب والسنة، ثم ذكرنا أهم القواعد الفقهية والمقاصدية التي تعتبر ناظمة للعمل الخيري والتطوعي مع بيان معانيها وأدلتها من النصوص الشرعية، ثم أبرز أدوار ومجالات العمل الخيري، وبعض معيقاته، والفصل الثاني قد ذكرنا فيه أهم التطبيقات للقواعد الفقهية والمقاصدية ذات الصلة بالعمل الخيري والتطوعي، ثم خاتمة اشتملت على أهم النتائج المستخلصة من هذا البحث وهي: ذكر أهم القواعد الفقهية والمقاصدية الناظمة للعمل الخيري والتطوعي، مع التطرق لمعانيها وحجيتها وتطبيقاتها في العمل الخيري والتطوعي. وبيان مفهوم العمل الخيري والتطوعي، وأهميته من خلال دوره وصوره، ثم بعض معيقات. عز وجل فيه. 􀍿 ثم ذكرنا بعض التوصيات: كالاهتمام بالبحث العلمي وإخلاص النية 112 The summary: The subject of our research, entitled: " The Rules Of Jurisprudence And Purposes Governing Charitable And Voluntary Work " -an applied theoretical study, included an introduction that contained a statement of the importance and objectives of this topic, represented in highlighting the most important rules of jurisprudence and purposes governing charitable and voluntary work. And the reasons for choosing this topic, is our desire for scientific research in general, and in this topic in particular. Also, the previous studies that dealt with same topic like ours,’ and the followed curriculum and methodology statement, Some obstacles faced us, The main problem was: what are the most important rules of jurisprudence and purposes governing charitable and voluntary work. To answer it, we made the following: in the first chapter we dealt with the most important definitions of the rules of jurisprudence and purposes that are considered to regulate charitable and voluntary work with their meanings and evidences from the Sharia texts, And to explain the concept of charitable and voluntary work, through its role, and then some of its obstacles. Then we mentioned some recommendations: paying attention to scientific research and sincerely intend to Allah Almighty in it.
