الكليات الفقهية لابن جزي القرناطي

Abstract

ملخص: الحمد لله والصلاة والسلام على رسول صلى الله عليه وسلم أما بعد فهذه مذكرة مقدمة لنيل شهادة الماستر والتي احتوت على مقدمة وفصلين وخاتمة وقد تحدثت في هذا البحث عن الكليات الفقهية والتي تبتدئ بكلمات كل متعقبة إما بكلية أوضابط فقهي وقسمت دراستي إلى قسم نظري :شرحت فيه تعريف الكلية والفرق بينها وبين نظيراتها وألحقه بالمصادر الفقهية أهمها وقسم تطبيقي: خصصته لدراسة الكليات الفقهية في باب الميراث من كتاب القوانين الفقهية لابن جزي، وقد ضم مجموعة من الكليات متفرعة بحسب حدود البحث تمت دراستها ببيان معانيها وأدلتها، مع الشرح والتأصيل . وضرب الأمثلة والتطبيقات والإشارة إلى المستثنيات إن وجدت وقد استوعب الكليات الفقهية معظم الأساسية علم الفرائض المعروفة وهي أسباب الميراث وشروطه وأسباب الميراث، والفروض المقدرة والحجب، وهذه الدراسة بينت أن الإمام ابن جزي يسير تعلم علم فرائض وذلل الصعاب وأزال الغموض الذي قد يعرض لدي دراسة هذا العلم ومن وسائله طرح المسائل في شكل الكليات لغاية سامية هي تسهيل أهم أبواب الميراث لصعوبتها. الكلمات المفتاحية : كلية – ميراث – فروق مقدرة summary: Praise be to God, and prayers and peace be upon the Messenger, may God bless him and grant him peace. As for what follows, this is a memorandum submitted for obtaining a master’s degree, which contained an introduction, two chapters, and a conclusion. In this research, I spoke about the jurisprudential colleges, which begin with words that each follow either a college or a jurisprudential officer. I divided my study into a theoretical section: I explained it in it. Definition of college, the difference between it and its counterparts, and its attachment to the most important jurisprudential sources And an applied section: I devoted it to studying the jurisprudential universals in the chapter on inheritance from the book of jurisprudential laws by IbnJazi. It included a group of universals branching out according to the limits of the research. They were studied by clarifying their meanings and evidence, with explanation and rooting. He gave examples and applications and pointed out the exceptions, if any. He has comprehended most of the basic principles of the science of well-known obligations, which are the causes and conditions of inheritance, the causes of inheritance, and the prescribed obligations and withholding. This study has shown that Imam IbnJuzaysir learned the science of obligations and overcame the difficulties and removed the ambiguity that might present me in the study of this science. One of its methods is to present issues in the form of universals for the lofty goal of facilitating the most important aspects of inheritance due to their difficulty.
