تعاطي الاعلام الالكتروني مع القانون العضوي المتعلق بالاعلام رقم 23-14

Abstract

تتطرقنا إلى دراسة تأثير القانون العضوي رقم 14/23 على تنظيم الإعلام الإلكتروني في الجزائر، مع التركيز على تطبيقاته العملية. تبدأ المذكرة بتقديم إطار نظري شامل للقانون، موضحة خلفيته القانونية وأهدافه الأساسية في تنظيم الإعلام الرقمي. يهدف هذا القانون، الذي أُقرّ في عام 2023، إلى ضبط عمل وسائل الإعلام الإلكترونية بما يضمن تقديم محتوى دقيق وموثوق، ويحافظ على حقوق الأفراد وحرياتهم، ويحقق توازنًا بين الرقابة وحرية التعبير. في الإطار النظري، تم تناول الأسس القانونية التي يرتكز عليها القانون العضوي 14/23، بما في ذلك مبادئ التنظيم الإعلامي وأهدافه الاستراتيجية. كما تم تحليل تأثير هذا الإطار على تنظيم الصحافة الإلكترونية وضمان مصداقية المعلومات المنشورة. أما في الإطار التطبيقي، فقد ركزت الدراسة على إجراء مقارنة بين أداء جريدة "سبق بريس" الإلكترونية قبل وبعد تطبيق القانون العضوي 14/23. تم تحليل التغيرات التي طرأت على جودة المحتوى الإعلامي، ومدى التزام الجريدة بالمعايير الجديدة المحددة في القانون. كما تم فحص كيفية استجابة الجريدة للتشريعات الجديدة، وما إذا كانت هناك تحسينات ملحوظة في مصداقية الأخبار وأداء الصحافة الرقمية. أظهرت النتائج أن تطبيق القانون قد أدى إلى تحسين ملحوظ في جودة المحتوى الإعلامي لجريدة "سبق بريس"، حيث أصبح هناك التزام أكبر بالمعايير القانونية وتقديم معلومات أكثر دقة وموثوقية. في الوقت نفسه، كانت هناك تحديات مرتبطة بتطبيق القانون، مثل الحفاظ على توازن بين الرقابة وحرية الصحافة.

Summary of the Study: This study addresses the impact of Organic Law No. 14/23 on the regulation of electronic media in Algeria, with a focus on its practical applications. The memorandum begins by providing a comprehensive theoretical framework of the law, outlining its legal background and core objectives in regulating digital media. This law, enacted in 2023, aims to regulate electronic media operations to ensure the provision of accurate and reliable content, safeguard individual rights and freedoms, and achieve a balance between oversight and freedom of expression. In the theoretical framework, the study covers the legal foundations underpinning Organic Law No. 14/23, including the principles of media regulation and its strategic goals. The impact of this framework on the organization of electronic journalism and the assurance of information credibility is analyzed. In the practical framework, the study focuses on comparing the performance of the electronic newspaper "Sabaq Press" before and after the implementation of Organic Law No. 14/23. Changes in the quality of media content and the newspaper's adherence to the new legal standards are examined. The study also assesses how the newspaper has responded to the new regulations and whether there have been noticeable improvements in news credibility and digital journalism performance. The results indicate that the implementation of the law has led to a significant improvement in the quality of media content for "Sabaq Press," with greater adherence to legal standards and more accurate, reliable information being provided. At the same time, challenges related to the law's implementation, such as maintaining a balance between regulation and press freedom, were also noted.
