الكليّات الفقهيّة من كتاب القوانين الفقهيّة لابن جزي دراسة فقهيّة

Abstract

ملخص: عالجت هذه المذكرة أحد أهم القضايا الفقهيّة الأكثر رواجا وتداولا في عصرنا والمتمثلة في الرهن والوكالة والضمان المتعلقة بفقه المعاملات. حيث قد تبيّنت بعض الأحكام الفقهيّة الخاصة بهذه الأبواب الثلاثة والتي دونت في كتاب القوانين الفقهية للإمام ابن جزي ـ رحمه الله ـ. وذلك من خلال التطرق إلى كلياتها الفقهية بشرحها وبيان أدلتها الشرعية وأيضا تطبيقات لها حتى تكون واضحة. وكل هذا جاء بعد أن تَوضَّح المعنى المراد بالكلية الفقهية، وكذلك عُرف بالإمام ابن جزي وكتابه القوانين مصدر تلك الكليات. الكلمات المفتاحية: الكليّات الفقهيّة، ابن جزي، القوانين الفقهيّة، الرّهن، الوكالة، الضما most discussed and popular in our time، which was represented in mortgage، agency and guarantee related to the jurisprudence of transactions. This is done by addressing its jurisprudential faculties by explaining them and explaining their legal evidence and mentioning examples of them to be clear. and all of this came after we clarified the meaning of the jurisprudential college، and introduced us to Imam Ibn jazi and his book jurisprudential laws and mentioned the source of those colleges.
