Abstract

ملخص البحث بالعربية: عنوان الموضوع: القواعد والضوابط الفقهية من كتاب الشرح الكبير للشيخ الدردير، باب المعاملات أنموذجا. تناول هذا البحث موضوع القواعد والضوابط الفقهية، الواردة في كتاب الشرح الكبير في باب المعاملات، وكان ذلك من خلال التعريف بالإمامين الجليلين، الشيخ خليل والشيخ الدردير،وبكتابيهما، المختصر والشرح الكبير. ثم تتابعت الدراسة بذكر نبذة عن القواعد الفقهية وتعريفها، ونشأتها، وأهميتها، ثم الفروق بينها وبين العلوم المشابهة لها، وذكر فوائد دراستها وحجيتها. ثم تمّ بعد ذلك استخراج بعض القواعد والضوابط الفقهية ،من كتاب الشرح في باب المعاملات حيث كان غنيّاً بالقواعد والضوابط الفقهية، فكان عدد القواعد المستخرجة ، ست قواعد ، منها كلية كبرى،كقاعدة "المشقة تجلب التيسير"،ومنها كليّة صغرى كقاعدة "التابع تابع". و بلغ عدد الضوابط الفقهية، خمس ضوابط "كضابط التردد بين السلفية والثمنية".

Abstract The title of this dissertation is “ the Jurisprudential Rules and Regulations from the great book of explanation to the Sheikh(Dardeer , in the chapter; typical transactions . in this humble work we are going to portray a small biography about the great persons ; sheikh khlalil and sheikh Dardeer. Then we have mentioned a hints about the Jurisprudential Rules and Regulations its definitions ,emergence, and its importance as well as the differences between both books and any similar books. In addition to the benefits from these studies . Furthermore, we extract some rules of the Jurisprudential Rules from the book of sheikh Dardeer , chapter moamalat , which was very rich . it contained precious data and rules about our topic . Rules like : the general rules ;rules derivative bring facilitation. And small rules ; the follower is pursuer. There are five Jurisprudential Rules me mention hesitating Jurisprudential between salafeya and al-thamaneya.
