ضوابط التحرير على مخالفة احكام التسعير

Abstract

ملخص كشفت المذكرة أن سلطة الدولة في معاقبة المخالفين لأحكام التسعير مضبوطة بقواعد الشريعة ومقاصدها لاسيما ضابط تحقيق العقوبة للمصلحة، وضابط التناسب بين المخالفة والعقوبة، وكذا ضابط مراعاة حال الجاني وظروف ارتكاب جريمته تطبيقا لمبدا التفريد العقابي. وقد انتهت المذكرة بخاتمة احتوت على جملة من النتائج والتوصيات والاقتراحات تدور حول مشروعية التسعير الجبري للسلع والخدمات المدعمة من الدولة، ومشروعية المعاقبة على المضاربة غير المشروعة، لاسيما على كل ممارسة مخالفة للاسعار المقننة، كما انتهت الدراسة الى ضرورة الاستفادة من الفقه الجنائي الاسلامي في مجال ترك الحرية للقاضي في تكييف الافعال الضارة بالسوق والمعاقبة عليها وفقا لضوابط الشرع ومقاصده الكلية. الكلمات المفتاحية: التسعير الجبري- ضوابط التعزير - تقييد المباح- سلطة الحاكم- مقاصد العقوبة. summary The study revealed that the state’s authority to punish violators of pricing provisions is governed by the rules and objectives of law, especially the standard of implementing the penalty for the benefit of the public, proportionality between the violation and the penalty, as well as taking into account the condition of the offender and the circumstances of committing his crime in application of the principle of punitive exclusivity.. The study ended with a conclusion that contained a number of findings, recommendations and suggestions revolving around the legitimacy of forced pricing of goods and services supported by the state, and the legitimacy of punishing illegal speculation, especially every practice that violates regulated prices. The study also concluded with the necessity of benefiting from Islamic criminal jurisprudence in the field of leaving freedom to the judge to accommodate actions that are harmful to the market and punish them in accordance with the rules of islamic law and its overall objectives.
