Abstract

ملخص البحث بالعربية الحمد لله رب العالمين والصلاة والسلام على أشرف المرسلين محمد وعلى آله وصحبه ومن تبعه بإحسان إلى يوم الدين وبعد: قد جاء هذا البحث بعنوان القواعد الفقهية المستخرجة من كتاب الإشراف على نكت مسائل الخلاف للقاضي عبد الوهاب البغدادي المالكي رحمه الله دراسة نماذج ، حيث - - قسمنا هذا البحث إلى مقدمة وفصلين وخاتمة، أما المقدمة فقد ذكرنا فيها أهمية البحث وأهدافه وأسباب اختياره وإشكالية البحث ثم الدراسات السابقة ثم منهج البحث ثم المنهجية المتبعة ثم الصعوبات التي واجهتنا في البحث ثم الخطة، وأما الفصل الأول ففيه التعريف بالمؤلف وبكتابه الإشراف وفيه مبحثين, وأما الفصل الثاني القواعد الفقهية المستخرجة من كتاب الإشراف وفيه ست مباحث، ثم خاتمة البحث وفيها أهم النتائج والتوصيات، ثم قائمة الفهارس. ومن أهم أهداف هذا البحث: 1 بيان دور وشخصية القاضي عبد الوهاب رحمه الله في التقعيد الفقهي المالكي - 2 - استخراج بعض القواعد الفقهية الكبرى أو الكلية المذكورة في الكتاب. ومن نتائج التي توصلنا إليها: 1 اختلف العلماء في ضبط عنوان الكتاب منهم من حذف كلمة نكت كابن فرحون - ومخلوف والحجوي ومنهم من أثبتها كالقاضي عياض والنباهي وهو الصحيح. 2 اهتمام القاضي عبد الوهاب رحمه الله بالقواعد الأصولية والقواعد الفقهية - والضوابط الفقهية. 3 أن العلماء اختلفوا في تعريف القواعد الفقهية والتعريف الراجح هو أنها قضية كلية - فقهية. 4 أن القواعد الفقهية تنقسم إلى قواعد فقهية كبرى وقواعد كلية. - 5 أن القواعد الفقهية تفترق عن القواعد الأصولية والقواعد المقاصدية والضوابط - الفقهية 6 أن القواعد الفقهية الكبرى خمس وهي الأعمال بالنيات، لا ضرر ولا ضرار - المشقة تجلب التيسير، اليقين لا يزول بالشك، العادة محكمة. والحمد لله وحده والصلاة والسلام على محمد وعلى آله وصحبه. ملخص البحث بالإنجليزية Praise be to God, Lord of the worlds, and prayers and peace be upon the most honorable of messengers, Muhammad, his family and companions, and those who followed him in goodness until the Day of Judgment. And after: This research came under the title of the jurisprudential rules extracted from the Book of Supervision by Judge Abd al-Wahhab al-Baghdadi al-Maliki, may God have mercy on him - a study of models - where we divided this research into an introduction, two chapters and a conclusion. Then the methodology followed, then the difficulties that we encountered in the research and then the plan. As for the first chapter, it contains the definition of the author and his book Al-Ishrafa, and it contains two topics. Among the most important objectives of this research: 1- Explaining the role and personality of Judge Abd al-Wahhab, may God have mercy on him, in the Maliki jurisprudence. 2- Extracting some of the major or general jurisprudential rules mentioned in the book. Among our results: 1- The scholars differed in determining the title of the book, including those who omitted the word jokes, such as Ibn Farhoun, Makhlouf, and Al-Hijwi, and among them were those who established it, such as Al-Qadi Ayyad and Al-Nabahi, which is the correct one. 2- Judge Abdel-Wahhab's interest in fundamentalist rules, jurisprudential rules, and jurisprudential controls. 3- Scholars differed in defining jurisprudential rules, and the most correct definition is that it is a comprehensive jurisprudential issue. 4- The jurisprudential rules are divided into major jurisprudential rules and general rules. 5- The rules of jurisprudence differ from the rules of fundamentalism, the rules of objectives, and the rules of jurisprudence 6- The major jurisprudential rules are five, which are actions with intentions, no harm or reciprocation Hardship brings ease, certainty does not disappear with doubt, habit is court.
