فقه الموازنة بين المصالح و المفاسد و اثرها في الفقه لااسلامي

Abstract

ملخص البحث يهدف هذا البحث إلى إيضاح مفهوم فقه الموازنات بين المصالح والمفاسد وبيـان أثرها في الفقه الإسلامي، من خـلال عرض النصوص الشرعية الدالة عليها من الكتـاب والـسنة، وأفعـال الـصحابة رضـوان الله عليهم، وما نقل عن العلماء في بيان منزلته ودوره في الترجيح بين المصالح والمفاسـد المتعارضـة، ممـايدل على مكانة هذا الفقه وأهمية مراعاته في حياة الناس. كما يهدف البحث إلى تبيينالأسس و الضوابط والقواعد التي تضبط استعمال هذا الفقـه وتطبيقـه عـلى أرض الواقع بالشكل الصحيح -حذرا من الوقوع في الاستخدام الخاطئله- وإسقاطه على نماذجتطبيقية من فقه المعاملات المعاصرة، العبادات، النوازل الطبية المعاصرة و كذا السياسة الشرعية التي يقوم عليها استقرار المجتمع وتنظيم العلاقة بين أفراده منذ عصر الرسول صلى الله عليه و سلم، و عصر الصحابة رضوان الله عليهم إلى يومنا هذا. الكلمات المفتاحية:الفقه ،الموازنة، المصالح ،المفاسد ، الجمع ، الترجيح

Research Summary : This research aims to clarify the concept of the jurisprudence of balances between interests and evils and to explain its impact in Islamic jurisprudence, by reviewing the legal texts that indicate it from the Qur’an and Sunnah, the actions of the Companions, may God be pleased with them, and what has been reported from scholars in explaining its status and role in weighing between conflicting interests and evils, which It indicates the status of this jurisprudence and the importance of observing it in people’s lives. We also try in the research to clarify the foundations, controls and rules that govern the use of this jurisprudence and its application on the ground in the correct manner, being careful not to fall into the wrong use of it. Then we take some applied models from the jurisprudence of transactions and worship, as well as the legal policy on which the stability of society and the organization of relationships are based. Among its members during the era of the Messenger, may God bless him and grant him peace, and the era of the Companions, may God be pleased with them.
