المصطلحات الفقهية عند السادة الحنابلة

Abstract

 الحمد لله رب العالمین، والصلاة والسلام على رسول الله نبینا محمد وآله وصحبه أجمعین. أما بعد: فهذه المذكرة تناولت بالد ا رسة: المصطلحات الفقهیة عند السادة الحنابلة، بالبحث والتطبیق، وتناولت المصطلحات من عدة زوایا في المذهب الحنبلي. فقد وضحنا الد ا رسة في فصل تمهیدي یُعنَى بمفهوم المصطلح الفقهي من خلال التعریف اللغوي والاصطلاحي له، كما بیّ نا أهمیته وأثره في تطور الفقه، ومدى اعتناء فقهاء الحنابلة به في كتبهم. ثم تعرضنا لد ا رسة المذهب الحنبلي من أهم زوایاه، في فصل أول یحتوي أربعة مباحث هي: ترجمة إمام المذهب، ثم نشأته، مرو ا رً بأشهر أعلامه وأهم مصنفاته، وصولاً إلى الأصول المعتمد في المذهب. ثم أفردنا لد ا رسة المصطلحات الفقهیة عند الحنابلة فصلا ثانیا ، احتوى على ثلاثة مباحث هي: مصطلحات الإمام أحمد، ثم مصطلحات أصحابه، وصولاً إلى ذكر مصطلحات الترجیح والتضعیف عندهم. وانتهت الد ا رسة بخاتمة لخصت أهم المحطات التي مرت بها الد ا رسة، وذیلت الد ا رسة بفهرس للآیات، وفهرس للأحادیث، ثم فهرس الم ا رجع والمصادر. هذا والله ولي التوفيق ملخص المذكرة ABSTRACT Praise be to Allah and peace be upon his Messenger prophet Muhammad , his family , and companions This thesis studied precisely the jurisprudence terms of Hanbali scholars and dealt with the terms from different angles in the Hanbali school. Therefore we made clear that study in preliminary chapter which cares the concept of the Fiqh idiom through its linguistic and idiomatical definition as well as we demonstrated either importance and its impact on the evolution of Fiqh and to what extend the Hanbali scholar writers look after it . Then , we one more time studied the Hanbali school in different ways in the first chapter containing a four sections namely : biography of the doctrine leader ,its origins , his most famous teachers and the well-known writings until doctrine Usul To study scientifically the Hanbali Fiqh idioms we specialized a second chapter that contains three sections which are Ahmad the leader terms and the ones of his companions besides to state the terms weakening and acceptation of the view All in all , the study conclusion summarized the most important stages through which the study went by also it has been indexed by a list of the verses,prophetic saying and antique companion’s speech then the references and sources.
