Abstract

ملخص الد ا رسة: تناولنا في هذه الرسالة بحث بعنوان" الاختيا ا رت الفقهية للشيخ ناصر السعدي من خلال تفسيره " نموذجان مختا ا رن هي مذكرة لنيل شهادة الماستر في الفقه المقارن وأصوله، والتي - – اشتملت على مقدمة وفصلين، حيث تطرقنا في الفصل الأول لترجمة الشيخ السعدي فسردنا أهم جوانب حياته العلمية وقمنا بذكر انجا ا زته ومؤلفاته كما عرجنا على بعض المصطلحات المتعلقة بهذا البحث، أما الفصل الثاني فقد تطرقنا لبحث اختيارين للشيخ يتعلق الأول بحكم ق ا رءة المأموم للفاتحة و ا رء الإمام في الصلاة الجهرية، أما الثاني فيتعلق بمسألة الظفر بالحق، وقد تطرقنا لذكر كل أقوال المذاهب في المسألتين مقرونة بأدلتها مع ذكر القول ال ا رجح، وفي الأخير ختمنا بحثنا بذكر أهم النتائج التي توصلنا إليه التي من بينها أن الشيخ السعدي عالم مجتهد متبع للدليل وليس متبع لمذهبه الحنبلي فقط. Study summary In this thesis, we dealt with a research entitled “The Jurisprudential Choices of Sheikh Nasser Al-Saadi Through His Interpretation” – two selected models – which is a note for obtaining a master’s degree in comparative jurisprudence and its origins, which included an introduction and two chapters. By mentioning his achievements and his writings, we also mentioned some terms related to this research. As for the second chapter, we discussed twoAs for the second, it is related to the issue of winning the truth, and we have touched on mentioning all the sayings of the schools in the two issues, coupled with their evidence, with mentioning the most correct saying, and in the end we concluded our research by mentioning the most important results that we reached, among which is that Sheikh Al-Saadi is a diligent scholar who follows the evidence and not only follows his Hanbali school.
