شهادة المرأة في الفقه الإسلامي

Abstract

ملخص البحث : إنّ إقامة الشهادة على وجهها الصحيح ، قربة إلى الله عزوجل ، لذا أمر الله تعالى عباده المؤمنين بأداء الشهادة ، وحث الله ورسوله على أدائها بالعدل ، لكي لا تضيع حقوق العباد ، ولإقامة شرع الله تعالى ، والدين الإسلامي الحنيف أعطى المرأة حقوقها بما يتلاءم مع طبيعتها ، فجعلها كالرجل في الحقوق العامة ، وعلى النصف منه في الدية والشهادة والميراث ، فكان من كمال شريعة الله قبول شهادة النساء على الحقوق التي تنفرد النساء بمشاهدتها كالولادة والبكارة و...، كما قبلت شهادتها في الحقوق المالية لشيوع البلوى بالمعاملات ، وعدم قبول شهادتها في القصاص وسائر الحدود ، لأنّ هذه الحقوق مما يطلع عليه الرجال ، ولما في ذلك من إعفاف المرأة ومراعاتها . Summary 67 Summary : Establishing testimony in its correct form is a means of drawing closer to Allah Almighty. Therefore, Allah has commanded His believing servants to give testimony, and He and His Messenger have encouraged its performance with justice so that the rights of individuals are not lost and to uphold the divine law. The noble Islamic religion has granted women their rights in accordance with their nature. It has made them equal to men in public rights, while they have a share that is half of that of men in blood money, testimony, and inheritance. The acceptance of women's testimony regarding rights that are specific to women, such as childbirth and virginity, is considered a perfection of Allah's law. Likewise, their testimony is accepted in financial rights due to the prevalence of deception in transactions. However, their testimony is not accepted in matters of retribution and other legal punishments, as these rights are known by men. This is done to protect the honor and respect of women.
