منهج الإمام الشاطبي في الفتوى

Abstract

تبعا للمنصب الخطير للفتوى ودورها الكبير في إصلاح أمور المسلمين والآثار المترتبة عليها، اخترنا في هذه الد ا رسة فتاوى شخصية من الشخصيات التي لها وزنها العلمي والمعرفي؛ وهو الإمام أبو إسحاق إب ا رهيم الشاطبي، وقد جاءت هذه الد ا رسة متكونة من فصلين، إذ أ ن الفصل الأول في التعريف بعنوان الد ا رسة وترجمة للإمام الشاطبي ولجامع الفتاوى ؛ حيث ب ي نا فيه مدلولات عنوان الرسالة، كما تطرقنا فيه إلى سيرة الإمام الشاطبي ومن ثم تعريفا موج ا ز لجامع الفتاوى، أما الفصل الثاني فهو عن منهج الفتوى عند الإمام الشاطبي وفيه تم التطرق إلى منهجه الذي سار عليه في إجابة مستفتيه بشكل مفصل، كما عمدنا فيه إلى تبيين المنهج أكثر من خلال ذكر المسائل في طيات المطالب الخاصة بكل مبحث ورد في هذا الفصل. أهم النتائج المستخلصة: عدم تعصب الإمام لمذهبه، اعتماده مشهور المذهب، أخذه الفقه عن العلماء المتقدمين، بسط البيان والتوسع في الاستدلال. الكلمات المفتاحية: الشاطبي، منهج الفتوى، فتاوى الإمام الشاطبي. And Chapter two is on the fatwa curriculum of Imam Al-Shatibi, which touches upon To his approach in his elaborate responses, in which we set out the curriculum more through Mention of issues in the pleadings of the respective claims in this chapter.The most important findings: Imam's intolerance of his doctrine, his accreditation of the famous doctrine, his understanding of scholars dilapidated, extending the statement and expanding the reasoning.
