الفأل الحسن بين التوجيه الأصولي والاستعمال الفقهي

Abstract

ملخص البحث : يتناول هذا البحث موضوعا بكرا قلّ من طرقه، في دراسة بينية بين العقيدة والفقه، فتوجه النظر في فصله الأول إلى تحديد ماهية الفأل الحسن بالرجوع إلى البيان النبوي، وما قرره العلماء ليصل إلى أن الفأل الحسن قسمان؛ أحدهما أمارة حسنة غير مكتسبة، والأخرى تسميةٌ حسنةٌ حتى متى سمع استبشر. ثم انتقل النظر إلى البحث في حكمه وحكمته وأدلته مبينا وجه دلالتها، معرجا إلى مناقشة رأي ابن عاشور رحمه الله تعالى فيما جنح إليه من كون الفأل الحسن لا يخرج عن جنس الطيرة . ثم أردف ذلك ببيان شروطه ـــ حيث أن العلماء لم يصرحوا بأكثر الشروط وإن كانت مقررة في تصرفاتهم ـــ ومن أهم تلك الشروط ألا يقصد إليه، وبين الخلاف فيه بأدلته، خاتما بيان الماهية بذكر معنى الطيرة وأهم الفروق بينها وبين الفأل الحسن . ثم حاول الباحث في فصله الثاني توجيهه أصوليا من مناح متعددة كبيان كيفية تأويله، وبيان أن دلالته على وقوع المراد في المستقبل ليست من دعوى علم الغيب في شيء، وبيّن أن التفاؤل في القدر عام وخاص وكذا التفاؤل في شرعه عام وخاص . ثم جاء الفصل الثالث فسرد ما تم استقراؤه من مسائل فقهية معللة بالتفاؤل مبينا ما يستفاد من هذا الاستقراء، واختار أنسب المسائل التي تصلح للدراسة فبحثها، وتعرض في الأخير لمعالجة بعض أخطاء الناس في استعمال الفأل تعميما للفائدة .

Research summar This research deals with a whole lot of its methods, in an interreligious study of doctrine and jurisprudence The first chapter of the study is aimed at determining what is a good hope by reference to the prophetic statement, and what the scholars decided to make it so that the good hope is divided; One is a good unearned Emirate, and the other is a good label even when he’s heard. He then proceeded to look at his judgment, wisdom and evidence, pointing out the significance of it. He then made a statement of his terms – since scientists did not state the most prerequisites, although they were determined in their actions – the most important of which is not to mean, and the disagreement with its evidence, conclude the statement of Mahiya by mentioning the meaning of the bird and the most important differences between it and the euphemism. In his second chapter, the researcher tried to orient him fundamentally from multiple walks to indicate how he was interpreted, and to show that his indication of the future occurrence is not a claim of absenteeism in anything, and that optimism in fate is general and special as well as optimism in its general and special legitimacy. Chapter III then listed the questions of jurisprudence that had been extrapolated on grounds of optimism, indicating the usefulness of such extrapolation, and selected the most appropriate issues that could be examined and which were at last presented with addressing some of the people’s errors in using astronomy to generalize the benefit.
