اثر الاستدلال الاصولي و التعليل الفقهي في الاختبارات الفقهية لابي بكر بن العربي من خلال كتابه القيس

Abstract

الملخص : يقدم هذا البحث شرحًا من أجلّ الشروح الحديثية، ومن أنفسِ شروح الموطأ، "كتاب القبس شرح موطأ مالك بن أنس"، لعلَم من أعلام مالكية المغرب الإسلامي ومن رواد المدرسة الجامعة بين الأثر والرأي، القاضي ابن العربي المالكي الإشبيلي الأندلسي، الذي قدّم لنا شرحاً متميزًا ظهر جليّاً في منهجه العام فيه من خلال حسن تبويبه وترتيبه له، وكذلك في غزارة الشرح باختياراته الفقهية في أبواب العبادات خاصة التي أفادها للقارئ متبعًا فيها مسلك الاستدلال والتعليل،فقد كان للاستدلال الأصولي والتعليل الفقهي أثرٌ بالغٌ في اختياراته الفقهية التي جاءت نتيجة اجتهاده بالأخذ من الأدلة الأصلية والتبعية لأجل استنباط العلل منها ومنه الانتصار لاختياره الفقهي. الكلمات المفتاحية:أبو بكر بن العربي، القبس، الاختيارات الفقهية، الاستدلال الأصولي، التعليل الفقهي.

Abstract This researchpresents an explanation of one of the mostdistinguished Hadith commentaries and one of the mostvaluablecommentaries on "Al-Muwatta". The book "Kitab al-QabasSharhMuwatta Malik ibn Anas" is by one of the notable scholars of Maliki jurisprudence in the Islamic Maghreb and a pioneer of the schoolthat combines tradition and opinion, Judge Ibn al-Arabi al-Maliki al-Ishbili al-Andalusi. He provided us with a distinguishedcommentary, evident in itsgeneralmethodologythroughits excellent categorization and organization. Additionally, the commentaryisrich in hisjurisprudentialselections, particularly in the chapters on acts of worship, whichhepresented to the readerfollowing a methodof reasoning and justification. The principles of reasoning and jurisprudential justification had a significant impact on hisjurisprudentialchoices, whichwere the result of his diligent effort to derivereasonsfromprimary and subsidiaryevidence. This allowedhim to advocate for hisjurisprudentialchoiceswithoutbeingbiasedtowardshisownschool of thought.
