Abstract

لممخص: تناكلت ىاتو الد ا رسة مصطمح البدعة، مف حيث النظر إلى مفيكمو، كما يترتب عميو مف أحكا شرعية، ربطا لو بقكاعد النظر كالاستدلاؿ،المبني عمى أصكؿ سميمة، كذلؾ ببياف آ ا رء العمماء في تكجيو الأدلة كبياف محامميا . كتكصمت د ا رستنا إلى أف الشريعة الإسلامية تنظر إلى تصرفات المكمفيف عمكما بمنيج يصمح لمعالجتيا في كؿ زماف، كبحسب الأحكاؿ، يحفظ.لمشريعة استم ا ررىا، كلممكمفيف إستق ا ررى الفكرم، كذلؾ بتطبيؽ أصكؿ ذلؾ المنيج الكممات المفتاحية: البدعة، القاعدة الأصكلية، القاعدة الفقيية، القاعدة المقاصدية Abstract : This study dealt with the term "heresy", in terms of the consideration of its concept and the legal provisions that it entails, linking it to rules of consideration and reasoning, based on sound origins, by stating the opinions of scholars in the guidance of evidence and the statement of their lawyers. Our study found that the Islamic Shari 'a viewed the actions of those entrusted with a general approach that could be dealt with at every time and, depending on the circumstances, preserved. Sharia law shall continue, and the mandate holders shall have their intellectual stability, by applying the origins of that valuable approach.
