Abstract

ملـــــــــخص الرسالة: استهدف هذا البحث دراسة أثر القواعد الفقهية و المقاصدية في حفظ وحماية البيئة ،و الانتقال من الشق النظري إلى الشق التطبيقي من أجل ملاحظة هذا الأثر عمليا. خاصة و أن تراثنا الإسلامي مليء بما يدل على اهتمام المسلمين و فقهائهم بهذا المجال غاية الاهتمام سواء من جهة التأليف في جميع عناصر البيئة ككتب الانسان والحيوان والنبات ، و سواء من جهة إدراج قضايا البيئة في الأحكام الشرعية عامة سواء كانت عبادات كأـحكام المياه وتلوثها ،أو معاملات كإدخال قواعد الضرر، أو عقيدة كالتركيز على مسألة الإستخلاف والأهم من ذلك هو تنظيرهم وتقعيدهم لهذه المسائل فقهيا ومقاصديا، مما يسهم في إلحاق ما استحدث من مسائل متعلقة بالبيئة مما يستجد للوصول إلى حل شرعي يعالج قضاياها المختلفة.
