Abstract

ملخص الدراسة تناولنا في هذا البحث الترجيحات الفقهية للإمام ابن رشد المخالفة للمذهب المالكي من خلال كتابه بداية المجتهد ونهاية المقتصد ( باب القصاص والديات أنموذجا ). فقمنا بدراسة المسائل التي اختارها ابن رشد في كتاب الجنايات دراسة فقهية مقارنة، وهذا من خلال ذكر أقوال الفقهاء فيها وأدلتهم، ومناقشتها، وكذا الرأي الذي رجحه المؤلف، حيث جاء هذا الموضوع في ثلاثة مباحث، خصصنا المبحث الأول لدراسة حياة ابن رشد الحفيد الشخصية والعلمية، إلى َ جانب مؤلفه، وكذا مفهوم الترجيحات، بينما خصص المبحث الثاني لدراسة ترجيحات ابن رشد الحفيد في باب القصاص، أما المبحث الثالث فتناولنا فيه المسائل المتعلقة بالديات. وقد خلص البحث إلى جملة من النتائج والتوصيات قد أشرنا إليها في الخاتمة. الكلمات المفتاحية: ابن رشد الحفيد، بداية المجتهد، الترجيحات، القصاص، الديات.

Study summary In this research, we discussed the jurisprudential preferences of Imam Ibn Rushd al-Hafid, the grandson, which are contrary to the Maliki school of thought, through his book, "Bidayat Al-Mujtahid WaNihayat Al-Muqtasid" (Chapter on Retaliation and Blood Money as an Example), so we studied the issues that Ibn Rushd chose in the Book of Crimes as a comparative jurisprudential study, and this is by mentioning the sayings of the jurists regarding them and their evidence. , and its discussion, as well as the opinion favored by the author, as this topic was presented in three sections. We devoted the first section to studying the personal and scientific life of Ibn Rushd the grandson, along with his author, as well as the concept of preferences, while the second section was devoted to studying Ibn Rushd the grandson’s preferences in Chapter on Retaliation, As for the third section, we dealt with issues related to blood money. The research concluded with a number of results and recommendations that we referred to in the conclusion.
