Abstract:
The offence of abducting children is one of the serious offences
dealt with by various legal systems in the form of Islamic criminal
jurisprudence and the Algerian Penal Code. This offence has become an
aggravation of Algerian society and threatens its entity, especially after
having succeeded terribly.
- The concept of kidnapping in Islamic jurisprudence and Algerian
legislation.
- Forms of child abduction in Islamic jurisprudence and Algerian law.
The phenomenon of abduction has become a serious phenomenon,
one of which is an attack on liberty and which has serious harm to the
individual and society because it has several cases of violence, including
the use of force, threats, intimidation or aggression, and the control of
freedoms.
The offence of abducting children as other offences is based on a
set of elements that become complete and may cease to be attempted
The Algerian legislator criminalized the act of kidnapping and provided for
a sentence of imprisonment, It is also punishable to attempt or proceed
with it that the Algerian legislator has put before the offender a way to
renounce him by making excuses for failure and linking them to certain
conditions. and increased the penalty to life imprisonment, especially for
the abduction of minor children.
Islam is the heavenly legislation that pioneers the preservation of
the child in terms of his reputation, honour and safety from the time he
was in his mother's belly and then after his birth until his attainment.
